{"id":231,"date":"2023-01-03T18:07:35","date_gmt":"2023-01-03T07:37:35","guid":{"rendered":"https:\/\/consadelaide.esteri.it\/servizi-consolari-e-visti\/servizi-per-il-cittadino-italiano\/servizi-notarili\/"},"modified":"2026-03-24T10:04:18","modified_gmt":"2026-03-23T23:34:18","slug":"servizi-notarili","status":"publish","type":"page","link":"https:\/\/consadelaide.esteri.it\/en\/servizi-consolari-e-visti\/servizi-per-il-cittadino-italiano\/servizi-notarili\/","title":{"rendered":"Notary service"},"content":{"rendered":"<p style=\"text-align: justify;\"><strong>Notary services are available only to <span style=\"text-decoration: underline;\">Italian citizens<\/span>\u00a0living abroad permanently or temporarily.<\/strong><\/p>\n<p style=\"text-align: justify;\">In accordance with the Italian national legislation (<em>Decreto Legislativo 3 febbraio 2011, n. 71<\/em><em>\u00a0&#8220;Ordinamento e funzioni degli Uffici\u00a0consolari&#8221; &#8211; Art.\u00a0<\/em><em>28 &#8211; Funzioni notarili<\/em>), the Head of the Consular Office exercises the functions of a notary exclusively for Italian citizens who live abroad permanently or temporarily. The only exceptions are if a deed must be signed by both a foreign and Italian citizen, as well as Atti Notori for marriage to be contracted in Italy by Australian or US citizens.<\/p>\n<p style=\"text-align: justify;\">The Consulate of Italy in Adelaide prepares documents and provides many of the services that, in Italy, would require the intervention of a notary, such as general and special power of attorneys, atti notori, signature authentication, dichiarazioni sostitutive di atti di notoriet\u00e0, etc. However,\u00a0<strong>the Office cannot provide any legal assistance\/advice<\/strong><\/p>\n<p style=\"text-align: justify;\">In any case,\u00a0<a href=\"https:\/\/consadelaide.esteri.it\/en\/chi-siamo\/contatti\/informazioni-utili\/list-of-reference-lawyers\/\">there are local lawyers<\/a>\u00a0able to draw up notarial deeds in Italian and to offer legal advice to those who need it, even towards citizens of other nationalities. It will always be the applicant&#8217;s responsibility to provide for the legalization of the same deed with an Apostille and for the translation of the power of attorney, if drawn up in English.<\/p>\n<p><strong style=\"text-align: justify;\"><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-881 img-fluid aligncenter\" src=\"https:\/\/consadelaide.esteri.it\/wp-content\/uploads\/2023\/01\/timbro-300x200.jpg\" alt=\"\" width=\"300\" height=\"200\" srcset=\"https:\/\/consadelaide.esteri.it\/wp-content\/uploads\/2023\/01\/timbro-300x200.jpg 300w, https:\/\/consadelaide.esteri.it\/wp-content\/uploads\/2023\/01\/timbro-1024x682.jpg 1024w, https:\/\/consadelaide.esteri.it\/wp-content\/uploads\/2023\/01\/timbro-768x512.jpg 768w, https:\/\/consadelaide.esteri.it\/wp-content\/uploads\/2023\/01\/timbro.jpg 1139w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/><\/strong><\/p>\n<p style=\"text-align: justify;\"><strong>The Consulate notary office will assist in preparing the following documents:<\/strong><\/p>\n<ul style=\"text-align: justify;\">\n<li>General and special power of attorney (proxies);<\/li>\n<li>Special Power of attorney for litigation;<\/li>\n<li>Revocation of Power of attorney;<\/li>\n<li>Atto Notorio;<\/li>\n<li>Affidavits;<\/li>\n<li>Deed of renunciation to inheritance;<\/li>\n<li>Copy of notary deeds.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><strong>WHAT TO DO:<\/strong><\/p>\n<ol>\n<li style=\"text-align: justify;\"><strong><span style=\"text-decoration: underline;\">Before booking an appointment<\/span>, please send an email to<\/strong> <a href=\"mailto:consolato.adelaide@esteri.it\">consolato.adelaide@esteri.it\u00a0<\/a> providing a contact phone number and <span style=\"text-decoration: underline;\"><strong>specifying the type of notary service required<\/strong><\/span>. In case of power of attorneys, please include in the email a draft of the document in WORD format<strong style=\"text-align: justify;\"> (below you can find some useful templates for reference) and a current valid Italian ID document. <\/strong>If the legal proceeding in Italy is already managed by a lawyer or a public notary, we strongly advise to double check in advance the draft with such professional, in order to ensure that the document later issued by the Consulate is in line with your needs<strong style=\"text-align: justify;\">;<\/strong><\/li>\n<li style=\"text-align: justify;\"><strong>You will subsequently be contacted by the Consulate to book an appointment<\/strong> for &#8220;Notary services&#8221; <a
